Volumental privacy policy

This privacy policy and terms of use ("Policy") describes the personal data collected or generated and the terms of use in connection with you being scanned via a Volumental VANDRA or VACKER scanner (“VANDRA” or “VACKER”, jointly the “Product”) or interact with Volumental AB (“us”, “we”, “Volumental”) through our website (the “Website”). This Policy describes the types of personal data collected when you use the Product and/or website and how your personal data is used, shared and protected. It also explains the choices you have relating to your personal data, e.g,. if you want to remove the data from our servers and how you can contact us. Further to this, it explains some of the terms applicable when getting scanned by the Products.


Handling of collected data

What Personal Data we collect and when

We ask you for certain personal data to provide you with the products or services you request. Some of the data we ask for is not strictly personal data in the legal sense of the word, but we want to give you an overview of all data we collect and for ease we call it all “Personal Data” in this Policy even if it does not mount to personal data in a legal sense.

 

We will collect Personal Data when you scan yourself in one of our Products or request to receive communications, create an account, participate in our events or contests, or interact with our Website.

 

This Personal Data may include your:

  • Contact details including name, email, telephone number, physical address and other personal details provided by you to Volumental or a third party facilitating the use of our Products;
  • Login and account information, including screen name and unique user ID;
  • Personal details including gender and date of birth;
  • Images, photos and videos collected when using our Products;
  • Data on physical characteristics, including body measurements such as width, length, arch height, heel to toe length and instep height for each of your feet with VANDRA and topography, imagery and measurements of your face with VACKER;
  • Personal preferences including your purchase history and preferences submitted by you;

 

When interacting with our Products and Website, data is automatically collected and shared with Volumental. For example, your web browser or mobile device may share certain data with Volumental as those devices interact with Volumental’s Products and Website. This data includes:

  • Device IDs, call state, network access, storage information and battery information
  • Cookies, IP addresses, referrer headers, data identifying your web browser and version, and web beacons and tags
  • Tools to manage what we collect

 

When using our Products and/or Website, we also inform you about our collection through the interface of the Products and on the Website. We also prompt you for your consent where relevant.

 

In many cases, your web browser or mobile device platform will provide additional tools to allow you to control when your device collects or shares particular categories of information. For example, your mobile device or web browser may offer tools to allow you to manage cookie usage or location sharing. We encourage you to familiarize yourself with and use the tools available on your devices.

 

Why and how we use your Personal Data

We use Personal Data we collect from you in the following ways:

  1. We may provide you with the recommendations, information and/or products based on the scans you make with our Products, to provide features on the Website and to service any other request you make using our Products or through our Websites. For example, if you scan your feet in a store, we may use that data to give you recommendations about which sizes of footwear would fit you based on the measurements of your feet; and if we scan your face in a store, we may use that data to provide you with recommendations or products based on the topography of your face.
  2. We may store and analyze your data to operate and improve our business, Products and services. For example, when you make a purchase, we may use that information for accounting, auditing and other internal functions. As another example, we may use data about how you use our products and services to enhance your user experience and to help us diagnose technical and service problems and administer our Products and Website.
  3. We may use Personal Data for promotional purposes. We may also allow third parties to use your information for promotional or research and development purposes to enhance your user experience.
  4. In certain cases, we may interact with a third party store or website where you are using one of the Products. Personal Data will be provided to us by the third party in accordance with their privacy policy in effect at the time they collected your information.
  5. We may use Personal Data to protect the rights, property and/or safety of Volumental or others.
  6. We may use Personal Data to prevent or detect fraud, abuse, illegal uses and violations of our user agreements and to comply with court orders, governmental requests or applicable laws.
  7. We use Personal Data about how our visitors use our Website and Products to understand customer behavior or preferences. For example, we may use information about visitors to our Website to better understand the best ways to organize and present the information available.

 

Sharing of your Personal Data

We may share your Personal Data with:

  1. Our affiliates for the purposes outlined above
  2. Third parties
    • We will only share your data with third for the purposes that we outlined above
    • Data may be shared with third party service providers in order to better manage our data, distribute emails, conduct research and analysis and manage brand and product promotions.
  3. We may transfer Personal Data in the event we sell or transfer all or a portion of our business or assets.

 

Protection and management of your data

Encryption & Security:

We use a variety of security measures, including encryption and authentication tools to maintain the safety of your Personal Data.

 

International data transfers:

The Personal Data we collect or generate (process) in the context of our Products and Website will be stored in the EU (Sweden, Germany, Ireland and Belgium).

Some of the data recipients with whom we shares your Personal Data may be located in countries other than the country in which your Personal Data originally was collected. The laws in those countries may not provide the same level of data protection compared to the country in which you initially provided your data. Nevertheless, when we transfer your Personal Data to recipients in other countries, including in the EU, we will protect that information as described in this Policy and in compliance with applicable law.

 

Retention of your data:

We retain your Personal Data for as long as necessary to fulfil the purposes for which we collect it, except if required otherwise by law. Because of the way we maintain certain services, after information about you is deleted, residual copies may take a period of time before they are deleted from our active servers and may remain in our backup systems.

 

Your rights related to your Personal Data

You have the right to withdraw your consent with respect to our use of any Personal Data as defined by law. You also have the right to access your data and to modification or deletion, in the event your data as stored by us are incorrect or otherwise unlawful. You can also contact us to exercise your rights of access, modification and deletion or to object to the processing of your Personal Data sending an email to privacy@volumental.com.

 

Using Volumental Products and Websites together with third party products and services

Our Products and Websites may allow you to interact with other digital products and services. If you use our Products or Websites in connection with a third-party product or service, your privacy rights on any third-party platform may be governed by the third party’s policies in parallel with the Policy. This will mean that any information the third party collects outside of our Products or Websites, but which the third party share with us, will be subject to the third party privacy policy.

 

Our Product or Websites may provide links to third-party websites and apps for your convenience or information. Linked sites and apps have their own privacy notices or policies, which we strongly encourage you to review. To the extent any linked websites or apps are not owned or controlled by us, we are not responsible for their content, any use of the websites or apps, or the privacy practices of the websites or apps.

 

Terms of Use

The Products may provide you with a recommendation for a certain product. This recommendation is merely a suggestion and any purchase decision or use should be done using common sense. Should the Products recommend a product you don’t think fit or suit you, you should always use your own judgement rather than the recommendation when making your decision.

 

Please ensure correct use of the Products through following the instructions given by the store employees or by the Products itselves. Incorrect use of the Products may lead to incorrect results and recommendations.

 

LIMITATION OF LIABILITY

WE WILL DO OUR BEST TO ALWAYS PROVIDE YOU WITH THE BEST SERVICE AND EXPERIENCE POSSIBLE. YOU EXPRESSLY AGREE THAT YOUR USE OF, OR INABILITY TO USE, THE PRODUCTS IS AT YOUR SOLE RISK. THE PRODUCTS AND SERVICES DELIVERED TO YOU THROUGH THE PRODUCTS ARE (EXCEPT AS EXPRESSLY STATED BY VOLUMENTAL) PROVIDED "AS IS" AND "AS AVAILABLE" FOR YOUR USE, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NONINFRINGEMENT. BECAUSE SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, THE ABOVE EXCLUSION OF IMPLIED WARRANTIES MAY NOT APPLY TO YOU.

IN NO CASE SHALL VOLUMENTAL, ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, OR LICENSORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF ANY OF THE PRODUCTS OR FOR ANY OTHER CLAIM RELATED IN ANY WAY TO YOUR USE OF THE PRODUCTS, INCLUDING, BUT NOT LIMITED TO, ANY ERRORS OR OMISSIONS IN ANY CONTENT, OR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF ANY RESULTS OR INFORMATION POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE PRODUCT, EVEN IF ADVISED OF THEIR POSSIBILITY. BECAUSE SOME STATES OR JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR THE LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, IN SUCH STATES OR JURISDICTIONS, VOLUMENTAL'S LIABILITY SHALL BE LIMITED TO THE EXTENT PERMITTED BY LAW.

VOLUMENTAL SHALL USE REASONABLE EFFORTS TO PROTECT INFORMATION SUBMITTED BY YOU IN CONNECTION WITH THE USE OF THE PRODUCTS, BUT YOU AGREE THAT YOUR SUBMISSION OF SUCH INFORMATION IS AT YOUR SOLE RISK, AND VOLUMENTAL HEREBY DISCLAIMS ANY AND ALL LIABILITY TO YOU FOR ANY LOSS OR LIABILITY RELATING TO SUCH INFORMATION IN ANY WAY.

VOLUMENTAL DOES NOT REPRESENT OR GUARANTEE THAT THE PRODUCT WILL BE FREE FROM LOSS, CORRUPTION, ATTACK, VIRUSES, INTERFERENCE, HACKING, OR OTHER SECURITY INTRUSION, AND VOLUMENTAL DISCLAIMS ANY LIABILITY RELATING THERETO.

 

Changes to this Policy

Applicable law and our practices change over time. If we decide to update our Policy, we will post the updated Policy on our Websites and in our Product interface. We strongly encourage you to read our Policy and regularly check for any changes. This Policy was last modified in July 2016.

 

Severability

If any of these Terms and Conditions of Purchase is deemed by any competent authority invalid, void or for any reason unenforceable to any extent, that term, condition or provision will be deemed severable from the remaining terms and conditions and will not affect the validity and enforceability of any remaining terms and conditions.
